MUMBAI,INDIA: The Confederation of Indian Industries (CII) organized a two-day international meet recently in Mumbai to investigate counterfeit, piracy, theft of trade secrets and intellectual property across all industries.

The discussion included global intellectual property (IP) trends, innovations, trade secrets, tackling counterfeiting and piracy, crime and punishment, brand protection solutions and strategies to authenticate brands.

Also the use of latest technologies and software programs to fight counterfeit and piracy. Addressing the gathering, K Balaji Majumdar, Joint Commissioner, Risk Management Division Indian Customs, discussed how the government has drafted the National Innovation Act (NIA) 2008 in order to protect the undisclosed information which includes products, method or processes or techniques, formula, pattern or design, compilation, program devices and data.

Further, Majumdar informed, "NIA 2008 has been framed under the National Integrated Science and Technology Plan by the Department of Science and Technology." He said the draft is still not in the final stage and it is slight broader compared to Patent and other laws.

However, Majumdar did mention that the word "data" has been defined well into context of duplication or counterfeit like any other products. Arpinder Singh, executive director KPMG, brought a new prospective in discussion with the stress on using technology (IT) to investigate acts of counterfeits and piracy.

He said, "In future, CFO's major concerns would be IP thefts and how to protect it." And added that investigation tool such as Case tracking system that helps in tracking computers, crack passwords, fast scan of information and retrieving data should be used effectively. Jim Simmons explained some online technological tools to curb and monitor brands and its duplication.

He said, "It's important to monitor the brands constantly and accordingly changes should be made in designs and packaging of products to avoid piracy." The tools include some monitoring solutions such as www.opsec.com, www.p4m.de, www.newmo.com and www.markmonitor.com.

All these websites help to generate reports and information on how company's products are counterfeited and duplicated in markets.

He added these solutions also show the amount lost by the brands due to duplication. These online tools are some of the latest web based solutions used for monitoring the branding and its violations.

In addition, Ravi C Chandwani, general manager - 3M Securities Systems Division, said "Counterfeiting started in China as a cottage industry and it has spread across the globe. With investment in technology, the companies and brands can bring the duplication and piracy of products."

Moreover, Chandwani discussed that the counterfeit and piracy can hamper the supply chains and so technologies having overt and covert features should be deployed with multi layer security approach.

Technology such as colour shifting, hologram, RFID, bar codes, 2D composite symbologies can counter duplication and piracy, he concluded.
